Rap group Home Team is suing Jermaine Dupri and Jacquees in federal court over their 2023 song “Pick It Up,” alleging the song infringed on protected elements of their 1992 song of the same name without permission or compensation.

The lawsuit claims that the lyrics and musical elements of Home Team’s original “Pick It Up” were utilized in the later recording without the brothers being credited as writers, as per the complaint detailed by AllHipHop. They are seeking more than $150,000 in damages, as well as credit as writers and a share of the publishing royalties from the newer recording.

The original version was released in 1992 as part of the album Via Satellite from Saturn on Home Team/Luke Records. Over 30 years later, Dupri and Jacquees laid down their own “Pick It Up” for Mass Appeal in 2023.

The case hinges on whether there was copying of legally protected expression from Home Team’s 1992 composition. The songs’ similarity isn’t, in and of itself, proof of copyright infringement, the pending lawsuit will need to address the specific elements that the plaintiffs say were used unlawfully.

The case, then, involves a decades-old rap recording that is at the center of a legal dispute involving two later-generation artists and a contemporary music company. The Watlers’ claims center on both the alleged use of their original work and the financial and songwriting recognition they say should have accompanied that use.

The case is still pending, and no court has yet ruled that the 2023 version of “Pick It Up” infringed Home Team’s copyright. The courts will decide whether the elements identified by the Watlers are protected by copyright and whether, if they are protected, they were used illegally.

Kanye West is asking a judge to put off a coming civil trial brought by a former Donda Academy security guard, stating he needs more time to get ready for the case.

The filing claims that Benjamin Provo and his attorney helped cause delays in discovery. The request comes as West’s legal team seeks sanctions against them.

The proposed delay also relates to West’s scheduled shows in Russia. His lawyers say the current trial date conflicts with performances scheduled for Oct. 10 and 11. But those shows are not yet confirmed.

The lawsuit dates back to Provo’s time as a security guard at Donda Academy. The ex-employee has made allegations about how he was treated at the school, including that West gave Black employees less favor and objected to books about notable Black figures.

Provo has also claimed West ordered him to cut his dreadlocks. Provo says he lost his job after refusing to cut his dreadlocks, which he claims were considered to have religious significance.

The Los Angeles Times included the allegations in a wider discussion on Donda Academy. West and the other defendants have denied the allegations in court papers.

The judge has not ruled on West’s request to push back the trial until May 2027. If approved, the change would give both sides more time before the lawsuit goes to trial and would also take the proceeding past the now scheduled October date.

The case remains unresolved, and the court must decide whether the October trial will proceed as planned or be postponed.
